Good News! The Commission on Elections (Comelec) announced the dismissal of the petition seeking to cancel the certificate of candidacy (COC) of the PDP-Laban presidential aspirant Rodrigo Duterte. The UP Student Council chairman who filed the petition didn't appeared on the preliminary conference.

Comelec dismissed UP Student petition against Rodrigo Duterte

According to Comelec, the petition was dismissed because the UP Student council chairman JP Delas Nieves, nor a lawyer to represent him, did not attended the preliminary conference at 10 a.m. Monday, January 11, 2016.

Comelec Clerk of the Commission Abigail Lilagan said that the rules and regulation of Comelec for a case of a cancellation of a COC may be dismissed if the petitioner or his counsel fails to attend the preliminary conference.

Aside from this petition, another preliminary conference is scheduled for Tuesday, January 12 at 10 a.m. and a hearing on the merits of the cases will happen at 2 p.m. of the same day.

According to CNN Philippines, "Delas Nieves accused Duterte of a misrepresentation in his COC by claiming that he will uphold the Constitution."

Nieves explained that Duterte's open admission of ordering summary executions shows that the latter does not honor the Constitution.
