Senator Grace Poe was in the hot seat when the camp of Vice-President Jejomar Binay raised an issue about the residency status of the senator. According to them, Sen. Poe cannot run for higher post on 2016 Elections because of her incomplete residency in the country.

But Atty. Romulo Macalintal explained that the signed certificate of candidacy (COC) of Sen. Grace Poe is a complete evidence that her residency has a total of 10 years and 1 month residence in the Philippines.

Sen. Grace Poe put signed her COC that she have six years and six months resident status in October 2012, which means that she will have a ten years and one month before May 2016 elections.

Atty. Macalintal said, "If Poe was a resident of the Philippines for '6 years and 6 months' in October 2012, then the additional period from October 2012 till the May 2016 elections which is three years and 7 months, will give her a total of 10 years and 1 month residence in the Philippines."

The lawyaer and Ateneo School of Government dean Antonio La ViƱa said on Tuesday, he pointed out constitutional law and the doctrine of animus revertendi in Poe's case, according to ABS-CBN News.

The said principle was used by the Supreme Court to decide on many election-related cases in the past.
