Former Senator candidate asked Comelec to remove Rodrigo Duterte to 2016 polls

The 2013 senator candidate Rizalito Yap David visit the Comelec and asked to exclude Davao City Mayor Rodrigo Duterte from the presidential elections 2016. David wants to declare as null and void Duterte's substitution to his PDP-Laban presidential bet Martin Diño by the Comelec.

David filed his petition to remove Mayor Duterte from presidential candidates list for 2016 polls and order the cancellation of the mayor's certificate of candidacy ''for not having validly and seasonably filed."

We all know that Comelec recently accepted Duterte's COC and his substitution for Martin Diño. The Senior Comelec commissioner Christian Rober Lim explained, "Basically, there was a compliance with matters of form. In terms of the intrinsic validity of the COC, that's the subject of the case,"

He added, "It has to be solved by the division and go to the en banc."

Last October 16, Martin Diño filed his COC but for some reason, he was just replaced by Mayor Duterte as substitution. However, Duterte's candidacy was put into problem after Diño mistakenly indicates that he was running for mayor of Pasay City, not president.

On the other hamd, Ang Kapatiran Party member David was also behind a petition against Senator Grace Poe for allegedly not being a natural-born Filipino.

Rizalito Yap David appeared on Comelec this Monday afternoon, December 21, 2015.
